Previously, she served in various senior leadership roles, most recently at a wholly-owned subsidiary of a global payment processor, card issuer, and merchant acquirer. <\/em><\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large\"><img decoding=\"async\" width=\"640\" height=\"250\" src=\"https:\/\/www.qgiv.com\/blog\/wp-content\/uploads\/2020\/01\/Sphere-Plus-Qgiv-Logos.png\" alt=\"\" class=\"wp-image-16894\" srcset=\"https:\/\/www.qgiv.com\/blog\/wp-content\/uploads\/2020\/01\/Sphere-Plus-Qgiv-Logos.png 640w, https:\/\/www.qgiv.com\/blog\/wp-content\/uploads\/2020\/01\/Sphere-Plus-Qgiv-Logos-300x117.png 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/figure><\/div>\n\n\n<h4 class=\"wp-block-heading\"><strong>Proactive Privacy:\nHow to prepare for upcoming privacy legislation<\/strong><\/h4>\n\n\n\n<p>The California Consumer Privacy Act\u2014or, as it\u2019s been dubbed\nby many, \u201cGDPR Lite\u201d\u2014marks the first time the US has really dealt with\nlegislation solely focused on the protection of privacy.&nbsp; While privacy has been addressed in\nlegislation (<a href=\"https:\/\/www.hhs.gov\/hipaa\/for-professionals\/privacy\/index.html\">HIPAA\nPrivacy Rule<\/a>, <a href=\"https:\/\/www.ftc.gov\/tips-advice\/business-center\/guidance\/how-comply-privacy-consumer-financial-information-rule-gramm\">GLBA\nPrivacy Rule<\/a>), it\u2019s typically been confined to specific industries\n(healthcare and finance, for example). <\/p>\n\n\n\n<p>The CCPA more broadly deals with the requirements of fairly\ndealing with personal information in that it is not tied to or targeting a\nspecific industry.&nbsp; Its target is any\ncompany doing business in California.&nbsp; <\/p>\n\n\n\n<p>What\u2019s more remarkable about the CCPA is that it marks a sea\nchange for US privacy regulation.&nbsp; Tired of\nwaiting for an omnibus federal law that has seemingly been in the works for\ndecades, state legislatures are taking the initiative in addressing the\nappropriate use of personal information.&nbsp;\n<a href=\"https:\/\/iapp.org\/news\/a\/us-state-comprehensive-privacy-law-comparison\/\">Since\n2018, 11 states have proposed new legislation and three (California, Nevada,\nand Maine) have passed bills into law<\/a>. <\/p>\n\n\n\n<p>With all of that momentum, it can be difficult for an\norganization to know what steps to take first.&nbsp;\nBut here are 5 steps that organizations can take to be ready to address\nforthcoming laws, regardless of what state they\u2019re in. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Data Flow and\nCategorization<\/strong><\/h4>\n\n\n\n<p>It sounds clich\u00e9, but you can\u2019t protect what you don\u2019t know\nyou have.&nbsp; So the first step that is\ntypically suggested is doing a data flow or data mapping.&nbsp; This helps you to determine where the date is\ncoming from, how it\u2019s being used, and who you might be sharing it with.&nbsp; You may find that you\u2019re collecting more data\nthan you need, or that you\u2019re sharing it with vendors that don\u2019t need it.&nbsp; <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Limit Collection of\nData<\/strong><\/h4>\n\n\n\n<p>Another old axiom in the data security and privacy business\nis \u201cdon\u2019t collect what you don\u2019t need.\u201d&nbsp;\nTo put it simply, it\u2019s difficult to disclose or inappropriately use data\nthat you don\u2019t have.&nbsp; Once you\u2019ve done a\ndata mapping exercise, you can review this with your team to determine which\ndata is strictly needed as opposed to \u201cnice to have.\u201d&nbsp; Moreover, many of the <a href=\"https:\/\/iapp.org\/resources\/article\/fair-information-practices\/\">fair\ninformation practices<\/a> are built on the notion of only collecting the data\nthat you need to complete transaction with the individual.&nbsp; <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Disclosures<\/strong><\/h4>\n\n\n\n<p>Transparency with your constituency about what data you\u2019re\ncollecting and when, and how it\u2019s being used is one of the simplest, but most\nimportant, steps that can be taken with respect to privacy.&nbsp; Visitors to your site, and consumers of your\nproduct or services, can\u2019t make informed decisions about sharing their data if\nthey don\u2019t understand how that data might be used. Providing clear and concise\ninformation about your information practices helps to engender trust and stands\nyou in good stead with legislative privacy regimes.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Awareness and\nTraining<\/strong><\/h4>\n\n\n\n<p>In today\u2019s economy, most of our businesses and nonprofits run on data.&nbsp; Whether we intend to or not, we become dependent on data transmission, data analysis, data storage, and data collection.&nbsp; That means that everyone in our organization is going to come into contact with personal data at some point.&nbsp; Given that fact, it\u2019s important that your team knows what data is considered sensitive, and how that data is to be treated. An important part of training, that can be easy to overlook, is how to report a potential incident.&nbsp; For example, what should be done in the event that someone has emailed a payment account number?&nbsp; <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Partner Agreements<\/strong><\/h4>\n\n\n\n<p>Organizations enter into partner and vendor agreements on a\nfrequent basis.
